Terms of sale and licence
These terms cover licences for Cinewright Budgeting and Scheduling and Cinewright Continuity, the Mac apps sold on getcinewright.com. Cinewright is made by Damon Winters (“we”). The Cinewright app for iPhone and iPad is sold through Apple’s App Store under Apple’s terms, not these.
Who sells to you
Our order process is run by Paddle.com, our online reseller and merchant of record. Paddle handles payment, sales tax and VAT, invoices and refunds. When you buy, you buy from Paddle, under Paddle’s buyer terms (paddle.com/legal/checkout-buyer-terms) as well as these terms.
What a licence lets you do
- Single licence and Education licence: one person, on up to two computers, in any mix of Mac and Windows.
- 5-seat licence: five people, each on up to two computers, in any mix of Mac and Windows.
- Cinewright Continuity licence: one person, on up to two Macs. It also opens script supervising in the Cinewright app for iPhone and iPad.
- Education licences are for study and teaching only, and are sold through discount codes schools give their own students after checking their student ID.
- A licence is for the person or company named in it. It works offline and needs no account.
- A licence covers every 1.x version, including its updates. A later major version may need a new licence.
- Budgeting and Scheduling licences bought before the Windows version ships include Windows when it ships. We don’t give a date for it.
Using the app without a licence
You can download Cinewright Budgeting and Scheduling free and use it without a licence. In free mode, PDFs, prints and pictures you export carry a small line saying the app is unlicensed. Don’t remove or hide that line.
What you may not do
- Sell, rent or pass on a licence, or share its licence text with anyone it doesn’t cover.
- Make, change or generate licences.
- Decompile, disassemble or reverse engineer the app, except to the extent the law expressly allows it despite this limit. This doesn’t limit what you do with your own files and exports: they are yours.
Cancelled licences
A licence that is refunded or charged back, or that is posted publicly, may be cancelled. The app then goes back to free mode. Your files are never touched, and every production still opens, reads and exports.
Your work and your data
Your productions stay on your own computers. We have no access to them, and the apps send nothing to us when you use them. See our Privacy page.
Figures are planning aids
Budget templates, union and labour rules, funder limits, tax-credit estimates and other figures in the apps are planning aids, labelled with their source and date. They are not financing, tax, payroll or legal advice. Check them with your funder, accountant or the rule’s publisher before you rely on them.
Warranty and liability
The apps are provided “as is”. To the extent the law allows, we give no warranty beyond what these terms say, and we aren’t liable for indirect or consequential loss, or for more than you paid for the licence. Nothing here limits rights you have by law that can’t be limited, including your rights as a consumer.
Refunds
See our Refund policy: you can ask for a refund within 14 days of purchase.
Trademarks
CINEWRIGHT™ is a trademark of Damon Winters. Other product names (for example Final Draft, Movie Magic, Gorilla and Showbiz) belong to their owners and are used only to say which files Cinewright imports or exports. Cinewright is not affiliated with or endorsed by them.
Law
These terms are governed by the laws of the State of Washington, USA, except where the law of the country you live in gives you rights that can’t be set aside.
Changes and contact
If we change these terms, the date above changes. The terms in force when you bought apply to that licence. Questions: support@getcinewright.com.
